Please read these Terms and Conditions carefully before using The Card Company app and services operated by Pockett Payments Technologies Pvt. Ltd.

By accessing or using TCC, you agree to be bound by these terms. TCC reserves the right to update these terms at any time, and your continued use of the platform constitutes acceptance of any changes.

Eligibility

Users must be legally capable of entering binding agreements, not barred from using the platform under applicable law, not impersonating others, and responsible for ensuring compliance by anyone they share their account with.

Definitions

The following terms have the meanings set out below:

"The Card Company / TCC" refers to Pockett Payments Technologies Pvt. Ltd. and its group entities. "You / User" refers to any individual accessing or using the TCC App or services. "TCC App" refers to the mobile application and related platforms operated by TCC. "TCC Group Entities" refers to subsidiaries, affiliates, and associated entities of TCC. "TCC Platform" refers to the complete suite of digital services offered by TCC. "TCC Website" refers to the official website of The Card Company. "TCC Services" refers to all financial, payment, and value-added services offered through the TCC App. "Commercial Partner" refers to merchants, billers, and service providers integrated with TCC. "Applicable Law" refers to all laws, regulations, and guidelines applicable in India. "Terms of Use / Terms and Conditions" refers to this document as updated from time to time.

Your Use of TCC

By using TCC, you agree to:

• Maintain only one account in your name. • Comply with all applicable laws and regulations. • Use the platform solely for personal, non-commercial purposes. • Provide accurate, complete, and truthful information at all times. • Maintain the confidentiality of your account credentials. • Refrain from reverse engineering, decompiling, or introducing malicious code. • Not post, transmit, or share any unlawful, infringing, or harmful content.

Supplemental Terms and Delivery of Services Through TCC Group Entities

Features including "My Wallet", "My Dues", and "Rewards" are subject to specific supplemental terms applicable to each feature. Your use of these features constitutes acceptance of the respective supplemental terms in addition to these general Terms and Conditions.

Violation of Terms of Use / Suspicious Activity

TCC reserves the right to suspend or terminate your account, with or without prior notice, in the event of any violation of these Terms, detection of suspicious activity, or exploitation of platform features in an unfair or unauthorised manner.

Termination / Deletion of Your Account

You may deactivate your TCC account at any time by following the process within the app. TCC may also suspend or terminate your account at its discretion.

Transaction records and account information will be retained for regulatory and compliance purposes as required by applicable law, including RBI guidelines.

Fees

TCC reserves the right to introduce, revise, or eliminate fees for any of its services without prior notice. By proceeding with a transaction after a fee has been displayed or communicated, you consent to the applicable charges.

Privacy

Your personal data is collected and processed in accordance with TCC's Privacy Policy. Data may be shared with subsidiaries, affiliates, commercial partners, and authorised third parties for the purpose of service delivery, regulatory compliance, and platform enhancement.

Disclaimer; No Warranties

All services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. TCC does not guarantee uninterrupted, error-free, or secure operation of the platform. You assume all risk associated with your use of the platform and any content downloaded or obtained through it.

Limitation of Liability

TCC and its affiliates shall not be liable for any injury, death, special, incidental, indirect, or consequential damages arising out of or related to your use of the platform.

The maximum cumulative liability of TCC to you for any claim arising from or relating to these Terms shall not exceed ₹10,000 (Indian Rupees ten thousand only).

Indemnity

You agree to defend, indemnify, and hold harmless TCC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the platform, your violation of these Terms, or your infringement of any third-party rights.

Disputes Resolution & Arbitration

All disputes shall be governed by the laws of India. TCC encourages resolution through its customer support and grievance redressal process in the first instance.

Unresolved disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Gurgaon, Haryana, India.

Use and Protection of Intellectual Property Rights

All intellectual property on the TCC platform, including trademarks, logos, software, and content, is owned by or licensed to Pockett Payments Technologies Pvt. Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the platform for personal purposes only.

Any content you submit to the platform grants TCC a worldwide, royalty-free, perpetual licence to use, reproduce, and distribute such content in connection with TCC's services.

Tax Liability

You are solely responsible for determining and discharging all applicable taxes, duties, and levies arising from your use of the platform and any transactions conducted through it.

Governing Law and Jurisdiction

These Terms are governed by the laws of India. The courts at Gurgaon, Haryana shall have exclusive jurisdiction over any disputes arising from or relating to these Terms.

Assignment

You may not transfer or assign any rights or obligations under these Terms. TCC may assign its rights and obligations to any group entity, acquirer, or successor without restriction.

General

Nothing in these Terms creates a partnership, employment, agency, or joint venture relationship between you and TCC. If any provision of these Terms is found to be invalid or unenforceable, it shall be replaced with an enforceable equivalent, and the remaining Terms shall continue in full force.

These Terms, together with all applicable supplemental terms, constitute the entire agreement between you and TCC.

Modification

TCC reserves the right to modify these Terms at any time without prior notice. Your continued use of the platform after any modification constitutes acceptance of the updated Terms.

Waiver

Failure by TCC to enforce any provision of these Terms shall not constitute a waiver of that provision. A waiver is only valid if made in writing and signed by an authorised representative of TCC.

Third-Party Links / Offers

The TCC platform may contain links to third-party websites or promotional offers. TCC is not responsible for the terms, privacy policies, or practices of any third-party sites and encourages you to review their policies before engaging.

Force Majeure

TCC shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control, including but not limited to strikes, pandemics, hacking incidents, natural disasters, or government actions.

Anti-Bribery and Sanction Laws

You agree to comply with all applicable anti-bribery and sanctions laws. You must not offer, promise, or provide anything of value to any government official or any person to obtain an improper commercial advantage in connection with your use of TCC.

Section A: Supplemental Terms for TCC Wallet α

Key Attributes of TCC Wallet α

TCC Wallet α is a digital prepaid payment instrument issued by Pockkett Payment Technologies Private Limited. Users may load monetary value into the wallet and use it for purchases, bill payments, and fund transfers as permitted under applicable RBI guidelines.

Onboarding

To activate your TCC Wallet, you must complete the required KYC process, which may include OTP verification, self-declaration, video verification, PAN checks, and fraud screening. By completing onboarding, you consent to these Terms and Conditions and the TCC Privacy Policy.

Use of TCC Wallet

You may access your wallet using your TCC App credentials and load funds via credit/debit cards, Netbanking, or UPI.

Pockkett Payments Technologies Private Limited reserves the right to suspend or terminate your wallet access in the event of information changes, unusual account activity, or KYC violations.

Closure of TCC Wallet

You may close your wallet at any time by logging out or submitting a closure request through the app. Remaining balances will be transferred back to the source account or your designated bank account following KYC completion.

Closure may be temporarily suspended in risk-based scenarios as determined by TCC.

Types of Wallets and Their Features

Minimum KYC Wallet: • Maximum balance: ₹10,000 • Monthly reload limit: ₹10,000; annual limit: ₹1,20,000 • No fund transfers to other accounts permitted • Monthly debit limit: ₹10,000 • No expiry (per RBI guidelines, November 2021) • Marked inactive after 1 year of no activity • On closure, balance transfers back to source or designated bank account

Full KYC / Video KYC Wallet: • Maximum balance: ₹2,00,000 • Monthly fund transfer limit per beneficiary: ₹2,00,000 • Indefinite validity subject to periodic KYC refresh • Marked inactive after 1 year of no activity • Full money transfer and purchase capabilities • On closure, balance transfers to pre-designated bank account

Fees

There are no fees for creating or using the TCC Wallet unless specifically stated. TCC reserves the right to introduce or modify fees; fees displayed in the app at the time of a transaction are binding upon proceeding.

Refund and Cancellation

All payments initiated through the TCC Wallet are final and cannot be cancelled or refunded by the user once processed. For erroneous payments, users must contact the merchant directly; TCC shall not be liable for such errors.

Refunds received from merchants will be credited back to the original payment source unless otherwise directed.

Supplementary Terms for Communication

TCC will send transaction alerts and service notifications via SMS, email, or push notifications to the contact information registered on your account. By using the platform, you authorise TCC to contact you even if your number is registered under DND (Do Not Disturb) preferences.

SMS and email notification services are provided on an "as is" basis; TCC shall not be liable for errors, delays, or non-delivery of communications.

Supplemental Terms for Minimum KYC Accounts

Minimum KYC wallets are available only to Indian citizens above 12 years of age. A Minimum KYC wallet expires 2 years from the date of issuance unless upgraded to a Full KYC wallet within that period.

Supplemental Terms for Non-Face-to-Face (Non-FTF) KYC Accounts

Non-Video Full KYC is available to Indian citizens above 12 years of age. Minor users must complete Video KYC by the age of 18 or within 1 year of account creation, whichever is earlier.

Aadhaar-based authentication is required for this KYC type; only the last 4 digits of the Aadhaar number will be stored.

Supplemental Terms for Video KYC (V-KYC)

Video KYC must be conducted via video call during TCC working hours and from within India only. A live location verification and stable network connection are required. You may be asked to provide photographs of documents and a signature sample during the process.

You must remain professional and cooperative throughout the V-KYC session. Non-compliance may result in account suspension. V-KYC may be rejected due to document issues, network failures, face mismatches, or if the user's location is detected outside India.

Supplemental Terms for Recharges and Bill Payments

TCC facilitates prepaid recharges and bill payments through its BBPOU partner, India Ideas Com Limited (BillDesk), or other authorised aggregators. TCC acts solely as a payment facilitator and is not the beneficiary of any such payments.

You are responsible for providing accurate registration, payment, and biller information. TCC assumes no liability for incomplete or inaccurate instructions, insufficient funds, bank or biller refusals, or circumstances beyond TCC's reasonable control.

TCC is not responsible for bill retrieval delays or transaction failures caused by third-party billers. Refunds, where applicable, are processed per biller policies within 5–7 working days to the original payment method.

Grievances

Level 1: Raise a complaint in-app via Help & Support. Level 2: Write to care@thecardcompany.in with your complaint details and Level 1 ticket reference. Level 3: Escalate to our Nodal Officer, Garima Agarwal, at nodal@thecardcompany.in, 15 days after Level 2 if unresolved.

Alternate Grievance Options

If your complaint remains unresolved through TCC's internal process, you may escalate to India Ideas Com Limited (BillDesk), the NPCI complaint portal, or the RBI Ombudsman under the Integrated Ombudsman Scheme 2021.
